1. Introduction

Welcome to Lokalshop ("we," "our," or "us"). By accessing or using our website (lokalshop.in) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Lokalshop operates as an online marketplace intermediary that connects local sellers with customers. We provide the technology platform to list products and manage orders, but we do not sell, stock, or deliver the products ourselves.

2. Our Role as an Intermediary

You acknowledge and agree that:

  • Lokalshop is not a party to any transaction: All contracts for the sale of goods are strictly between the Seller and the Customer.
  • We do not handle payments: All payments are arranged directly between the Customer and Seller (e.g., via UPI, Cash) outside of the Lokalshop platform. We are not responsible for any failed payments, refunds, or fraud.
  • We do not handle delivery: Delivery logistics are the sole responsibility of the Seller. We are not liable for delayed, missing, or damaged shipments.
  • We do not guarantee product quality: We do not inspect or warrant the quality, safety, or legality of any products listed by Sellers.

3. User Responsibilities

Whether you are a Seller or a Customer, you agree to:

  • Provide accurate and truthful information (Name, Phone Number, Address).
  • Maintain the security of your account and OTP verification.
  • Use the platform only for lawful purposes. You may not list or request illegal, prohibited, or offensive items.
  • Interact respectfully with other users on WhatsApp or other communication channels facilitated by us.

4. For Sellers

By listing your business on Lokalshop, you represent and warrant that:

  • You have the legal right to sell the products you list.
  • Your product descriptions and images are accurate and not misleading.
  • You are responsible for fulfilling orders and handling customer service issues, including returns and refunds.
  • You will comply with all applicable laws and regulations in India regarding your business operations.

5. Limitation of Liability

To the maximum extent permitted by Indian law, Lokalshop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of:

  • Your use of or inability to use the service.
  • Any conduct or content of any third party (including Sellers and Customers) on the service.
  • Any products purchased through the service.

6. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Thane, Maharashtra.

8. Contact Us (Grievance Officer)

You agree that in case of a dispute/grievance related to the Services of the Company, You shall, before taking such matter to the court of Law, report it to the Company (by sending an email at support@lokalshop.in) as soon as possible. The Company hereby undertakes to resolve/settle the dispute to the best of its abilities within a reasonable time.
